GeneGate is a technology platform that enables users to explore their health, wellness, and ancestry through genetic insights. These Terms of Service (“Terms”) govern your access to and use of the GeneGate website, mobile applications, and services (collectively, the “Platform”). By creating an account, purchasing a kit, or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

These Terms of Service (“Terms”) govern your access to and use of the GeneGate website, mobile applications, and services (collectively, the “Platform”). By creating an account, purchasing a kit, or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

  • Sells and delivers DNA collection kits,
  • Provides a secure digital platform for customers to register, track, and view results,
  • Collects and manages customer personal data,
  • Coordinates sample processing with licensed laboratories and bioinformatics partners.
2. Our Role in Processing

GeneGate acts as a data controller for your personal data (e.g., name, contact details, account data, preferences).

GeneGate does not itself perform genetic testing or analysis. Instead:

  • We send your anonymized sample to a licensed laboratory for DNA extraction and genotyping/sequencing.
  • The lab provides GeneGate with a de-identified genetic code output (no names, emails, or addresses).
  • GeneGate then transmits this genetic code to a bioinformatics technology provider, who generates wellness and trait insights.
  • Neither the lab nor the bioinformatics provider can link this data to your identity.
3. What Personal Data We Collect

We collect:

  • Account Data: name, email, phone, delivery address, password.
  • Order & Payment Data: billing details, transaction history.
  • Sample Data: kit barcode, status updates (but not identifiable genetic results).
  • Genetic Insights: result interpretations linked to your account, delivered via our platform.
  • Technical Data: device type, IP, analytics, cookies (see Cookies Policy).
4. Why We Process Your Data
  • Service Delivery: to deliver your kit, track its processing, and display your results.
  • Secure Data Mapping: to link your anonymous genetic data with your account and present it privately to you.
  • Payments, Fraud Prevention & Support: to process payments and handle inquiries.
  • Regulatory Compliance: to meet DHA, PDPL, and other applicable requirements.
5. Sharing & Cross-Border Transfers

We may share data with:

  • Licensed Laboratories: to process your sample. They receive only the kit barcode, not your name or contact details.
  • Bioinformatics Providers: to analyze genetic code and produce reports. They receive de-identified genetic data only.
  • IT, Hosting & Payment Providers: for secure platform operations.
  • Regulators: when legally required.

Some processing occurs outside the UAE (e.g., in the United States). We use contractual safeguards or request your explicit consent where required to ensure your data is protected.

6. Data Segregation & Security
  • Your personal identifiers (name, email, address) are stored separately from your genetic code.
  • Only GeneGate can re-link the two.
  • Labs and tech partners operate on anonymized codes and cannot identify you.
  • Data is encrypted in transit and at rest, with strict access controls.
7. Your Rights

You have the right to:

  • Access and receive a copy of your data,
  • Rectify errors,
  • Erase your data (“right to be forgotten”),
  • Restrict or object to processing,
  • Request portability of your data,
  • Withdraw consent at any time (for optional processing).

8. Retention
  • Personal data: stored while you maintain an account + [5 years] thereafter for legal compliance.
  • Genetic data links: retained until you delete your account or request erasure.
  • Raw genetic code: retained by GeneGate’s secure servers; labs destroy samples after processing.
  • Anonymized data: may be stored for research/statistics (if you consented).
9. Children’s Data

We only process data for minors with verifiable parental/guardian consent.
